# GifForge Terms of Use

These Terms of Use ("Terms") govern your use of the GifForge iOS application and related services made available by GifForge ("we", "us", or "our"). By using GifForge, you agree to these Terms.

## 1. The Service

GifForge is a local-first media utility that allows users to select videos, trim them, crop them, and export GIF or MP4 files directly on-device.

The current version of GifForge is designed so that source-video processing happens locally on your device by default.

## 2. Eligibility

You must be at least 13 years old to use GifForge, or older if the law in your jurisdiction requires a higher minimum age.

## 3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use GifForge for personal or internal business use in accordance with these Terms and applicable law.

## 4. Acceptable Use

You agree that you will:
- use GifForge only with media you own or have permission to use;
- comply with applicable copyright, privacy, export-control, and other laws;
- not use GifForge to infringe intellectual property rights or privacy rights;
- not attempt to interfere with the app, reverse engineer protected components except where prohibited by law, or misuse App Store purchase flows; and
- not use the app in connection with unlawful, abusive, fraudulent, or misleading activity.

## 5. User Content

You remain responsible for the videos and exported media you process using GifForge.

We do not claim ownership of your source media. You represent that you have all rights necessary to process that media using the app.

## 6. Subscriptions and Billing

GifForge may offer an auto-renewable subscription called GifForge Pro.

If you purchase GifForge Pro:
- payment is charged to your Apple Account at confirmation of purchase;
- the subscription renews automatically unless canceled at least 24 hours before the end of the current billing period;
- your account is charged for renewal within 24 hours before the end of the current period; and
- you can manage or cancel your subscription in your Apple Account subscription settings.

Pricing may vary by region and storefront. Apple handles billing, payment processing, and refund workflows subject to Apple’s terms.

## 7. Purchase Restoration

If you previously purchased a subscription through Apple, you may use the app’s restore purchases functionality or Apple’s subscription management tools to restore access where applicable.

## 8. No Warranty

GifForge is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

We do not guarantee that the app will always be uninterrupted, error-free, or compatible with every file, device, or workflow.

Because GifForge performs media processing locally, performance may vary based on device model, operating system, available storage, and selected export settings.

## 9. Limitation of Liability

To the fullest extent permitted by law, GifForge and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business interruption arising from or related to your use of the app.

If applicable law does not allow certain limitations, some of the above limitations may not apply to you.

## 10. Termination

We may suspend or terminate access to the app or support channels if required by law, requested by Apple, or if you materially violate these Terms.

You may stop using the app at any time by uninstalling it. Canceling a subscription is handled through Apple subscription management.

Your use of GifForge is also subject to the GifForge Privacy Policy:

## 12. App Store Terms

If you downloaded GifForge from Apple’s App Store, you acknowledge that these Terms are between you and GifForge, not Apple, except that Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent permitted by law.

Your use of the app must also comply with the applicable App Store terms.

## 13. Changes to the Service or Terms

We may modify the app or these Terms from time to time. If we make material changes, we may update the effective date and provide additional notice where appropriate.
